This Privacy Policy outlines how we collect, use, disclose, and protect the information you provide when you use our website, vitalisivtherapy.com (the "Site"), and our services, including our client portal and any related communications.

  • Profile Information: To complete your profile and receive medical clearance, we require your phone number, date of birth, and emergency contact information (name, relationship, and phone number). Providing your physical address is optional.
  • Health Information: As part of the medical clearance process, you will provide health information to our third-party medical partner, Guardian MD. We do not store your detailed medical history on our servers, but we do receive and store your clearance status (e.g., "Approved," "Pending," "Denied") and its expiration date.
  • Communications: When you contact us via email or phone, we may collect the information you provide in those communications.

2.2 Information Collected Automatically

  • Log Data: Our servers automatically record information that your browser sends whenever you visit our Site. This may include your IP address, browser type, pages visited, time and date of your visit, and time spent on pages.
  • Cookies and Similar Technologies: We use cookies to collect information and improve our services. You can instruct your browser to refuse all cookies, but some portions of our Site may not function properly without them.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To provide, maintain, and improve our services, including the client portal and booking functionalities.
  • To manage your account and profile.
  • To facilitate the medical clearance process with our third-party partner.
  • To communicate with you about your account, appointments, and clearance status via email and SMS.

  • With Medical Partners: We share your name and email with Guardian MD to initiate the medical clearance process. The health information you provide to them is subject to their own privacy policy.
  • For Legal Reasons: We may disclose your information if we believe that disclosure is reasonably necessary to comply with any applicable law, regulation, legal process, or governmental request; to enforce our agreements and policies; or to protect the rights, property, or safety of Vitalis IV, our users, or the public.

5. SMS/Text Messaging Terms

Vitalis IV LLC sends SMS text messages only to clients who have explicitly opted in by checking the optional SMS consent checkbox during the client portal profile setup. Providing your phone number does not automatically enroll you in SMS communications. You may use all portal features without opting in to SMS. Messages sent to opted-in clients may include:

  • Notifications regarding your medical clearance status.
  • Appointment reminders and confirmations.
  • Updates related to your account.

Message and data rates may apply. Message frequency is approximately 1–3 messages per month depending on your account activity. You can opt out of receiving text messages at any time by replying STOP to any message. Reply HELP for assistance. Opting out of SMS will not affect your ability to use the client portal or receive email communications.

SMS opt-in data and consent are never shared, sold, rented, or transferred to any third parties or affiliates for marketing or promotional purposes. The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6. Data Security

We take reasonable measures to protect your personal information from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. We use industry-standard encryption (HTTPS/TLS) for all data transmitted between your browser and our servers. However, no internet or email transmission is ever fully secure or error-free. Please keep this in mind when disclosing any personal information to us via the internet.

7. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you services. You may request deletion of your account and associated data at any time by contacting us at the information below. We will retain certain information as required by law or for legitimate business purposes.

  • Communications: You can opt-out of receiving promotional emails by following the unsubscribe link in those emails. You may opt out of SMS messages at any time by replying STOP to any text message from us.
  • Data Deletion: You may request deletion of your personal data by contacting us directly.

9. Third-Party Links

Our Site may contain links to third-party websites, including Guardian MD's telehealth platform and Square's booking system. This Privacy Policy does not apply to those sites, and we encourage you to review their respective privacy policies before providing any personal information.

10. Children's Privacy

Our services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that a child under 18 has provided us with personal information, we will take steps to delete such information promptly.
